Ex-Agent Representation

What value do you think that an ex-agent, now employed in some other industry, has to offer when they represent themselves by owner?  We've been loosing 100+ members in our board annually since 2005.  that is 20% of our membership.  Some exiting agents want to sell their home by owner.  If you were one of those agents would you be a FSBO or would you work with a full time agent and a brokerage? 

No matter how skilled or world renowned a lawyer may be they don't represent themselves in court.  What about real estate agents?  A local city attorney was arrested on criminal charges and hired a lawyer.  He assisted with the preparation of his case, compiled case law, and discussed the legal merits of a point of law that affects his case.  He put hundreds of hours of research into his case and could easily have prepared Motions, but he didn't represent himself. 

We've lost about 1% of "value" per month since January 2006.  Some property has been reduced even more.  If a FSBO is on the market for 1 year on their own they've lost 12% of their value.  The home could have been priced 5% under value a year earlier and sold a year earlier saving the home owner all of those interest payments on their mortgage. 

Consider these areas:

1.  Emotional involvement tied to the sale 
2.  Pricing
3.  Showings
4.  Potential to telegraph motivation (demeanor, body language or voice)
5.  Responding to offers and counter offers
6.  Internet marketing
7.  ForSaleByOwner.com as MLS access
8.  Marketing associated with a local brokerage and / or a franchise
9.  The concept that knowledge is power and the party that knows more is more likely to "win" in a negotiation. 
10.  Would the buyer or buyer's agent have an advantage working directly with a seller.

Credit Card Interest

Now that the world has changed my seller's are getting socked with more bad news.  Credit card companies have raised interest rates.  The companies don't write a letter to let them know.  The seller (or buyer) gets their statement and suddenly the minimum payment is $100 more than it was last month. 

If your credit card company raises your rate send a certified return receipt letter immediately.  Tell the company that you, "Do not accept the new terms and that you "reject" the new offer."  "That you do not authorize an increase to your interest rate or new terms."  And, "To cancel the card at the current terms if they will not reinstate your old interest rate and terms."

The wording is important.  A credit card company can change your terms with your permission.  If they send you new terms and you pay then you've accepted the new terms.  The new terms may follow the statement or arrive with it printed on paper as thin as a page from the bible in 7 point font.  If you can read the words with your glasses and a magnifying glass you may slip into a coma before you get to the end.  Just refuse to accept the terms!

I've sent these letters a few times.  In all of the instances the credit card companies have reinstated my old rate.  Except American Express who reduced the new rate to a mid way point.  As soon as I pay off my Sign and Travel I'll cut up my American Express card and throw it in the garbage.

Tom Tom vs Garmin

This is our unscientific test of the Tom Tom and the Garmin.  We took 5 trips across Florida by SUV with friends.  To make our "control" group we decided to go with the Tom Tom directions if the Garmin and Tom Tom were to disagree.  Then to simplify it further we named Tom Tom "Suzy" and Garmin "Sally."

In every single instance the Suzy was right (Tom Tom).  This made about a dozen Sally (Garmin) directions incorrect.  There was only one instance when Suzy failed us and took us to a steak house that turned into a Hooters.  The error was corrected the next time we took a trip less than a month later.

So my choice for accuracy and ease of use is the Tom Tom!

Loop Holes 2 Year Requirement

We all know that the 1997 tax code granted single homeowners a $250,000 and married couples a $500,000 deduction on their primary residence as long as they lived in the home 2 out of the last 5 years.  If there has been an event that a homeowner did not anticipate before buying and occuping the residence you may not be held to the 2 year requirement.  Death, job loss, divorce, multiple births, a broken marriage engagement all qualify for a break.  Check with your real estate accountant to make sure you don't loose something you are entitled to.

Identity Theft

You can spend $110 a year to by LifeLock's ID security or you can do what they do for free.  LifeLock puts a fraud alert on your credit reports and renews them every 90 days.  LifeLock also "opts out" of preapproved credit offers from the credit agencies.  The last thing is they contact the Direct Marketing Association (DMA) to remove your name from mailing lists.  You can do all of these things yourself for free.  You won't be 100% protected, but then again, no one is.  LifeLock does not come with any guarantee or reimbursement for any losses if your ID is stolen.  This is simply one of the things you can do for yourself to protect your credit.

Finding Money

Do you think there is money out there waiting for you to find it?  There are lots of places to go to check!  The US Treasury Department and the IRS track money that has been unclaimed.  Call the IRS Hotline at (800) 829-1040.  Also check out the National Taxpayers Union's tax-refund finder http://www.ntu.org/.  Try The Treeasure Hunt site to find old US Savings Bonds at http://www.treasurydirect.gov/.

Check out www.unclaimed.org/ and www.missingmoney.com/ too.  Both are run by the National Association of Unclaimed Property Administrators and they have records from most states that track unclaimed property.  You can check every state that you've ever lived in!

If you find something worth claiming contact the state.  They will give you directions to claim your stuff.  You'll need to verify who you are in the usual ways.  You may need your social security number, a death certificate or a copy of a will.

Life Estate Florida

I have a seller who inherited a property after her father passed on.  Her father retained a life estate and deeded the property to her 3 years ago.  He married a woman 2 years later.  Does the new wife have a life estate to the property?  No!  The Life Estate ends with death.

Motorcycles Can Change Your Life

I called to talk to a friend and she answered the phone sobbing.  Her fiancé and business partner was in a motorcycle accident 4 blocks from their home in Lakeland Florida.  The wedding was planned for Thanksgiving weekend just a week from now.  My friend asked me if I know a smart real estate lawyer in Lakeland Florida.  I don't.  Do you?  Let me know so I can pass it on to her. 

The last time I talked to her she was glowing and chattering about this wonderful man and how much she loved him.  She told me how he hadn't left her side since hurricane Wilma.  He dropped everything to go to the Keys to save her home that had been flooded.  He ripped out the drywall and got to work renovating.  She didn't know what she would do without him.  We were standing in her yard when he called to say he had a flat tire.  She took off in her flip flops to rescue him.  She was going to introduce me to him that day.

Today, I'm consoling her through a telephone as she sobs and grieves.  I'm hearing about his favorite country songs and a concert they went to and that he had once sang with Willie Nelson.  If things were not bad enough, her 78 year old mom found out she has cancer in a lung and her heart this week.  Her mother-in-law to be also has cancer. 

In an instant her life has changed forever.  Hug the people you love.  Tell them how much they mean to you.  Don't let today end with out telling the people you love how much you love them.

Frivolous Escrow Dispute

What do you do when a seller decides to make claim to the escrow deposit when you are the listing agent and there is no valid excuse except revenge for cancellation of a contract?  What do you do when you are the buyers agent?

I recently had a seller make claim when my buyer cancelled the contract 5 days into the inspection period.  I thought we were protected with the 10 day inspection period.  The buyer had been to the bank once and talked to her bank every single day since the day we offered.  The buyer wanted out when she realized she might not qualify for the loan.  She lucked out when we found a house that was twice as big and twice as nice on a corner lot with 2 sea walls for virtually the same price.  It would have been worth it to her to loose the deposit.  BUT, it wasn't right.  Why didn't the listing agent tell her seller that she shouldn't make that claim? 

My buyer was forced to sit and wait for the company to turn in the paper work to FREC.  She wrote a letter.  I wrote a letter.   Then the broker sent FREC the wrong address.  Months later we are still sitting here wondering what is the matter with this company, this agent and this seller.

How Did They List So Far Below Market?

This month 3 Buyers I'm working with picked properties that were listed with discount brokers.  All of the homes were listed $30,000 or more below market value so my buyers were very interested.  The one on the market the shortest time had been on the market almost 150 days.  I had over looked the listings because there were no pictures or 1 bad picture, limited information and difficult to work with agents.  I couldn't believe I hadn't noticed these steals and I couldn't believe the other 1,100 in the area and 450 agents in my immediate area had not noticed the steals.  I couldn't help but wonder if the sellers knew what fantastic deals their homes were.  I thought I could get atleast $30,000 more per home if I had the listing.

HOW DID THEY CONVINCE A SELLER TO LIST SO FAR BELOW ALL OF THE OTHER HOMES?  How did the agents get away with no pictures and no tour and no information?  How could these steals sit on the market SO LONG?

The Agents have packages:  1% to the listing agent, and 3% to the selling agent.  They do paper work.  Then there is 2% to them and 3% to the buyer's agent.  Or they have a 3% to the listing agent and 3% to the buyer agent where the do some of the stuff that full service agents do.  Unless the listing agent gets both sides then they give 1% back.

House #1.  The house had 1 picture in the MLS and no virtual tour.  We went to see it and they loved it.  I called the agent to tell him that we were going to write an offer tonight.  We wrote an offer that night.  I called the agent to tell them we were ready.  Then I called the next day and left another voice mail.  By 5 pm and 4 voice mails later I went to the company and it was locked.  The agent called me 2 days later and told me to put it under the door mat.  Then I didn't hear anything for 4 days after a dozen voice messages.  When I finally talked to the agent they said they had another buyer and their offer had been accepted.  "Sorry."  I asked the agent why they did not call me to say there was another offer and give my buyer the chance to submit another offer with a higher offer.  The agent said, "The seller just liked my offer."

House #2.  The agent couldn't meet me on a Saturday or Sunday at anytime because they were busy.  I understand - it happens to all of us.  I went and took pictures and made a virtual tour to send to my buyer.  My buyer liked it.  I called to make an appointment for the day they were arriving.  The agent couldn't meet me at anytime that day or the next.  They told me it was fine to take my buyer anyway.  My buyer loved the house and told me they wanted to make an offer but noticed a lot of damage.  There was no electricity in some of the rooms.  The spouse told us the rooms had not had electricity since hurricane Wilma.  The wiring looked strange around the washer and dryer and a few other things.  I called the agent to ask for a Seller's Disclosure and left a voice message.  I called back a few hours later and talked to the agent who was sounded drunk and was in a bar.  There was no response.  After 24 hours I called again and I sent an e-mail.  I sent another e-mail and called twice the next day.  I didn't want to annoy the listing agent, but my buyers were anxious and worried about the problems.  After a week we got the Seller's Disclosure and it said there was absolutely nothing wrong with the house.  Safety is a big concern for this family.  A dozen things conflicted with what the spouse told my buyer which made my buyer uncomfortable.  Since there were so many questions I thought I'd make it easier and write a letter so the agent wouldn't be taking notes for 10 minutes and forget something.  I called the agent and left a voice mail that we had some questions and that I would e-mail the questions to him or he could call me.  The agent didn't call me the next day.  The agent didn't call the following day.  The next day I called again.  The agent sound really pissed and said, "If your're going to get all formal this is going to take a few days!"  I said I didn't want to be formal and it would be fine if he called the seller, jotted down a few notes and called me.  He said it was Friday and he would call me on Monday.  No call on Monday so I called again.  He gave me 2 of the answers and told me that if it was such a big deal to me I should go talk to his seller.  The only problem was I had appointments that I couldn't miss.  We wrote an offer even without the answers.  I called to tell him that we were e-mailing an offer.  The agents said, "Oh, I got a buyer and we already have a contract."  I was shocked.  He did not call us to tell us so that we could make our best offer. 

House #3.  I called an expired listing.  The seller and I made an appointment.  I told him I had a buyer that was interested in the house.  The seller let me bring the buyer by and said they really cut out their first agent.  I appreciate that kind of loyalty.  The buyer and seller talked and seemed like everything was great.  Then the agent called.  I told her the buyer wanted seller financing for 2 years for a portion of the sales price.  She said, "I will not recommend that to my client!"

Key West

Key West is gorgeous in November. I don't know why the hotels, bars, beaches and restaurants are not over flowing with people. There is no humidity. The sky is clear. Everyone is having a perfect hair day and all the women look beautiful. No one is sweating off their makeup and everyone has a spring in their step from the extra boost from Mother Nature. March is the beauty queen that gets all of the publicity after her crazy sister "Fantasy Fest." November is the pretty girl next door that no one knows about. If you get the chance to visit in November you will be in heaven. The hotels are cheap. The streets are empty. You have the town to yourself EXCEPT for the World Championship Power Boat Races that are going on. Don't miss Yacht Race Week either! Yes, it's so hot in the summer. But the beauty of the rest of the year will knock you off your feet right into an inviting hammock as you gaze at the ocean. Or maybe cheer from Mallory Square as you watch those million dollar boats race by! There is nothing like a few days before Super Boat Race Week. As you drive on U. S. 1 it seems like every other car is a Ferrari, Jaguar or super expensive car. Everyone is a beauty queen. Money, after all, may bring happiness.
